Terms of service

1. Who provides the service

Tomáš Foltas, a sole trader under the Czech Trade Licensing Act, company ID (IČO) 06777198, Novodvorská 1068/7, 641 00 Brno, Czech Republic (the “provider”). Not a VAT payer. Contact: info@tomasfoltas.cz.

These terms govern the use of the FckScrn online service at fckscrn.com (the “service”) and the relationship between the provider and whoever uses it to run an event (the “organizer”).

The FckScrn software is also open source under the AGPL-3.0 licence. Running it on your own server is governed by the licence, not by these terms.

2. What the service is

The service helps show presentations at events: the organizer builds the programme, speakers upload their slides through their own links, and the computer in the room downloads everything in advance and plays it on the right screens. It also includes audience questions and polls, a partner loop, the speaker's phone as a remote and an event page.

No sign-up is needed. Access to an event's admin is a secret link the organizer receives when creating the event. Whoever has the link can manage the event; the organizer keeps it like a password and creates a new one in the admin if it leaks.

3. Trial mode

Every new event is free in trial mode. The whole service works; the projection just shows a “Zkušební režim” (trial) watermark. Trial mode is for trying the service and gives no further rights.

4. Ordering and the contract

• The organizer orders an event in its admin with Activate event: enters billing details, agrees to these terms and sends the order.
• Sending the order concludes a contract for the service for that event. The event is activated right away and the watermark disappears.
• The organizer is responsible for correct billing details.

5. Price and payment

• The price is per event according to the price list valid at the time of the order: one room CZK 1,490, several rooms (up to 5) CZK 4,990. The provider is not a VAT payer; the price is final.
• After the order, the event admin shows a proforma invoice under Invoices, due in 14 days (bank transfer, QR payment). A proforma is a request for payment, not a tax document.
• Once the payment arrives, the provider issues the invoice, available in the same section, usually by the next business day.
• If the proforma is not paid within 7 days after its due date and after a reminder, the provider may return the event to trial mode (with the watermark). Paying activates it again.
• Payments are matched by the variable symbol (reference). Without it or with a different amount the payment may not be matched automatically; an e-mail helps.

6. Event content

• Content uploaded by the organizer, speakers or the audience (slides, notes, videos, partner loop, questions, polls) is the responsibility of whoever uploaded it and of the event organizer. The provider does not review content; it only stores, converts and plays it.
• The organizer grants the provider permission to store, convert (e.g. to PDF) and display the content as needed to provide the service, for as long as the event is stored.
• Content that breaks the law or the rights of others (copyright, personality rights) does not belong in the service. The provider may remove such content after notice or block the event.
• Audience questions are visible to everyone with the questions link. The organizer can hide them.

7. Storage and deletion

• An event and all its files are deleted automatically 14 days after the event date; an event without a date 60 days after it was created.
• Before that the organizer can download everything as one ZIP in the admin, or delete the event right away.
• Deletion is final; the provider does not restore deleted data.
• Accounting documents (proformas, invoices) are kept as long as the law requires. See the privacy policy.

8. Availability and liability

• The provider works to keep the service reliable and built it so that a talk runs even without internet (the room computer downloads everything in advance). Uninterrupted availability of the server cannot be guaranteed, e.g. due to maintenance and outages of providers or the internet.
• We recommend preparing and syncing the room computer in advance and keeping a backup of important presentations.
• The provider is liable only for damage caused intentionally or by gross negligence. For other damage, compensation is limited to the price paid for the event concerned. The provider is not liable for lost profit, indirect damage or content uploaded by users. This limitation does not apply where the law does not allow it, in particular to harm to health and to consumer rights that cannot be limited by contract.

9. Complaints and refunds

• If the service did not work as it should, write to info@tomasfoltas.cz, ideally within 30 days after the event, describing what happened. The provider replies within 30 days.
• If a defect of the service spoiled the event, the provider refunds a reasonable part of the price or the whole price.
• An ordered event that has not taken place yet can be cancelled by e-mail; a paid price is refunded within 14 days.

10. Consumers

Most organizers order as businesses. If you order as a consumer:

• You may withdraw from the contract without giving a reason within 14 days of the order, by e-mail to info@tomasfoltas.cz.
• By ordering you ask for the service (activation of the event) to start right away. If you withdraw after the service has been partly provided, you pay a proportionate part of the price. Once the service has been fully provided with your consent (the event has taken place), the right of withdrawal ends.
• Disputes can also be resolved out of court through the Czech Trade Inspection Authority (adr.coi.cz).

11. Final provisions

• Matters not covered by these terms are governed by Czech law, in particular the Civil Code.
• The provider may change these terms. A change does not apply to events ordered before it. The current version is always on this page.
